Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the FORNAX Database for Astrophysical Part of Białków Observing Station (“Database”), operated by the University of Wrocław, Poland. By creating an account or using the Database, you agree to be bound by these Terms. If you do not agree, you may not use the Database.

2. Purpose of the Database

The Database provides access to astronomical data collected by the Astrophysical Part of Białków Observing Station. The data is made available for scientific, educational, and non-commercial purposes.

3. User Accounts

To register an account, you must provide the following information:

• First and last name
• Email address
• Title / Academic Status
• Affiliation
• Password
• Requested role within the Database

We also store:

• Account creation date
• Last login date (visible only to administrators)

Passwords are stored securely using hashing.

Account activation requires two steps:

1. Email confirmation – you must verify your email address before your account can be considered for approval.
2. Approval by a higher-authority user – your requested role must be approved by a user with higher authority. Approval is discretionary: a user with higher authority may decline to approve your role request or remove your profile at any time, without obligation to provide an explanation.

Until your account has been both confirmed and approved, you may not use the Database.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You may delete your own account at any time. Upon deletion, all of your personal data will be permanently removed from our systems, except where retention is required by applicable law.

4. Permitted Use

• You may use, download, and analyze the data for research, educational, and personal study purposes.
• If you use the data in publications or presentations, you must acknowledge the appropriate observers and, if required, add University of Wrocław employees as co-authors after prior contact with researchers for the Astronomical Institute of University of Wrocław.
• Commercial use, redistribution, or resale of the data without prior written permission is strictly prohibited.

5. User Responsibilities

• Misuse the Database or attempt unauthorized access.
• Share your login credentials.
• Upload or distribute malicious code.
• Violate applicable laws, including data protection and copyright.

6. Privacy

We collect and process your personal data solely for the purpose of account management, access control, and academic reporting. Your data will not be sold or shared with third parties, except as required by law. For more details, see our Privacy Policy.

7. Disclaimer

The University of Wrocław provides the Database and data “as is” without warranties of any kind. We do not guarantee continuous availability, completeness, or accuracy of the data.

8. Limitation of Liability

To the maximum extent permitted by law, the University of Wrocław is not liable for any direct, indirect, or consequential damages arising from your use of the Database or data.

9. Termination

We may suspend, restrict, or terminate your account at any time if you violate these Terms, misuse the Database, or fail to comply with approval requirements.

You may also choose to terminate your account yourself at any time. In such case, your personal data will be deleted without delay, unless retention is required by law.

10. Governing Law

These Terms are governed by the laws of the Republic of Poland and applicable the European Union regulations.
